Peru’s competition regime is centered on Legislative Decree No. 1034 (2008) – the Law on the Repression of Anticompetitive Conducts (“Ley de Represión de Conductas Anticompetitivas”), followed by Law No. 31112 (2021) – the Merger Control Law (“Ley de Control Previo de Operaciones de Concentración Empresarial”). The enforcement authority is the National Institute for the Defense of Competition and Protection of Intellectual Property (“Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual”, INDECOPI). INDECOPI was created in November 1992 and began operations in March 1993 under the competition remit.
